est\u00e1 exclu\u00eddo?<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As empresas ou os trabalhadores independentes que tenham adquirido o ve\u00edculo para uso profissional n\u00e3o poder\u00e3o apresentar queixa em tribunal, mas poder\u00e3o <strong>participar na a\u00e7\u00e3o extrajudicial<\/strong> se tiverem tido avarias relacionadas com o defeito do motor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Isto deve-se ao facto de a legisla\u00e7\u00e3o espanhola diferenciar o regime de prote\u00e7\u00e3o dos consumidores e utilizadores do das pessoas colectivas ou dos trabalhadores independentes, que n\u00e3o gozam dos mesmos direitos neste tipo de ac\u00e7\u00f5es.<\/span><\/li>\n<\/ul>\n<h2><a href=\"https:\/\/puretechlegal.com\/documentacion-necesaria-reclamar-por-el-motor-puretech\/\"><b>Passo 2: Re\u00fane a documenta\u00e7\u00e3o necess\u00e1ria<\/b><\/a><\/h2>\n<p><span style=\"font-weight: 400;\">Para aderir ao pedido, a pessoa em causa deve fornecer uma s\u00e9rie de documentos para constituir o processo judicial:<\/span><\/p>\n<h3><b>Documentos essenciais:<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Documento comprovativo da compra do ve\u00edculo<\/b><span style=\"font-weight: 400;\"> (fatura, contrato, financiamento, pagamento do imposto de circula\u00e7\u00e3o ou transfer\u00eancia banc\u00e1ria).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>As facturas de repara\u00e7\u00e3o que pretendes reclamar,<\/b><span style=\"font-weight: 400;\"> que estejam relacionadas com a avaria do motor (substitui\u00e7\u00e3o da correia, avaria do motor, consumo excessivo de \u00f3leo, avaria da bomba de \u00f3leo, etc.).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Prova de manuten\u00e7\u00e3o regular<\/b><span style=\"font-weight: 400;\"> (facturas de mudan\u00e7a de \u00f3leo e de filtro, revis\u00f5es ou o livro de manuten\u00e7\u00e3o coberto e carimbado), especialmente as dos \u00faltimos 3 anos.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u2757 <\/span><i><span style=\"font-weight: 400;\">\u00c9 essencial poder provar que a manuten\u00e7\u00e3o foi efectuada de acordo com as instru\u00e7\u00f5es do fabricante, uma vez que a Stellantis argumenta frequentemente que houve falta de manuten\u00e7\u00e3o para se dissociar da culpa.<\/span><\/i><\/p>\n<h3><b>E se n\u00e3o tiveres todos os documentos comprovativos?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Em alguns casos, os hist\u00f3ricos de manuten\u00e7\u00e3o podem ser reconstitu\u00eddos atrav\u00e9s de Se a senten\u00e7a for objeto de recurso, este prazo pode aumentar para 5 anos.<\/span><\/p>\n<h2><b>Custos e taxas do processo<\/b><\/h2>\n<h3><b>Quanto custa apresentar uma queixa?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Neste processo <\/span><b>n\u00e3o h\u00e1 custos iniciais<\/b><span style=\"font-weight: 400;\"> para a pessoa em causa. Se fores APT, ter\u00e1s 15 dias para decidir se queres continuar com o processo. Se quiseres continuar, ter\u00e1s de pagar 50 euros pela an\u00e1lise efectuada. Caso contr\u00e1rio, poder\u00e1s desistir sem qualquer custo.
