Ante la pasividad de algunos fabricantes a la hora de asumir responsabilidades fuera del periodo de garant\u00eda, ha surgido una v\u00eda legal s\u00f3lida: la <\/span><b>reclamaci\u00f3n colectiva<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Esta gu\u00eda tiene como objetivo explicar de forma clara, ordenada y jur\u00eddicamente fundamentada <\/span><b>c\u00f3mo funciona el proceso de reclamaci\u00f3n colectiva<\/b><span style=\"font-weight: 400;\">, qu\u00e9 se necesita para participar, cu\u00e1nto cuesta y qu\u00e9 resultados puede obtener un afectado.<\/span><\/p><p><span style=\"font-weight: 400;\">La reclamaci\u00f3n colectiva presenta <\/span><b>ventajas evidentes frente a una reclamaci\u00f3n individual<\/b><span style=\"font-weight: 400;\">, ya que permite unificar esfuerzos legales, reducir costes procesales y aumentar la presi\u00f3n frente al fabricante. no?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Pueden participar en la reclamaci\u00f3n colectiva todos los particulares que:<\/span><\/p>\n<ul>\n<li style=\"\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sean o hayan sido propietarios de un veh\u00edculo con <\/span><b>motor 1.2 PureTech (gasolina)<\/b><span style=\"font-weight: 400;\"> afectado.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hayan sufrido aver\u00edas relacionadas con el desgaste prematuro de la correa de distribuci\u00f3n.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Acrediten el cumplimiento del mantenimiento recomendado por el fabricante.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Disponen de documentaci\u00f3n justificativa (ver paso 2).<\/span><\/li>\n<\/ul>\n<h3><b>\u00bfQui\u00e9n queda excluido?<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Empresas o aut\u00f3nomos que hayan adquirido el veh\u00edculo para uso profesional no podr\u00e1n reclamar judicialmente, pero <strong>si podr\u00e1n unirse a la reclamaci\u00f3n extrajudicial<\/strong> si han tenido aver\u00edas relacionadas con el defecto del motor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Esto se debe a que la legislaci\u00f3n espa\u00f1ola diferencia el r\u00e9gimen de protecci\u00f3n para consumidores y usuarios frente al de las personas jur\u00eddicas o aut\u00f3nomos, quienes no gozan de los mismos derechos en reclamaciones de este tipo.<\/span><\/li>\n<\/ul>\n<h2><a href=\"https:\/\/puretechlegal.com\/documentacion-necesaria-reclamar-por-el-motor-puretech\/\"><b>Paso 2: Recopilar la Documentaci\u00f3n Necesaria<\/b><\/a><\/h2>\n<p><span style=\"font-weight: 400;\">Para incorporarse a la reclamaci\u00f3n, el afectado debe aportar una serie de documentos que permitan construir el expediente legal:<\/span><\/p>\n<h3><b>Documentos imprescindibles:<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Documento que acredite la compra del veh\u00edculo<\/b><span style=\"font-weight: 400;\"> (factura, contrato, financiaci\u00f3n, pago del impuesto de circulaci\u00f3n o movimiento bancario).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Facturas de reparaci\u00f3n que quieras reclamar,<\/b><span style=\"font-weight: 400;\"> que est\u00e9n relacionadas con el fallo de motor (cambio de correa, rotura de motor, consumo excesivo de aceite, fallo de la bomba de aceite, etc).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Justificantes de mantenimiento peri\u00f3dico<\/b><span style=\"font-weight: 400;\"> (facturas de cambios de aceite y filtros, revisiones o el libro de mantenimientos cubierto y sellado), especialmente los de los \u00faltimos 3 a\u00f1os.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u2757 <\/span><i><span style=\"font-weight: 400;\">Es fundamental poder demostrar que el mantenimiento se realiz\u00f3 conforme a las indicaciones del fabricante, ya que Stellantis suele argumentar la falta de mantenimiento para desentenderse del fallo.<\/span><\/i><\/p>\n<h3><b>\u00bfY si no tengo todos los justificantes?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">En algunos casos se pueden reconstruir los historiales de mantenimiento a trav\u00e9s de talleres o servicios oficiales.<\/span><\/p>\n<h3><b>Herramientas para escanear y enviar documentaci\u00f3n<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Se recomienda escanear todos los documentos con aplicaciones como:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Adobe Scan<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CamScanner<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Microsoft Lens<\/span><\/li>\n<\/ul>\n<h2><b>Paso 3: Firmar la Hoja de Encargo y Unirse a la Reclamaci\u00f3n<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">La hoja de encargo es el documento que <\/span><b>formaliza la relaci\u00f3n entre el afectado y el despacho de abogados<\/b><span style=\"font-weight: 400;\">. Firmarla no implica ning\u00fan pago por adelantado, pero s\u00ed supone:<\/span><\/p>\n<h3><b>Compromisos y derechos legales:<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ceder la representaci\u00f3n legal al bufete para actuar en nombre del cliente.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Aceptar las condiciones de la reclamaci\u00f3n, incluidas las comisiones por \u00e9xito.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">El derecho a ser informado peri\u00f3dicamente del estado del caso.<\/span><\/li>\n<\/ul>\n<h3><b>Preguntas frecuentes sobre este paso:<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00bfPuedo abandonar el proceso despu\u00e9s de firmar? \u2192 S\u00ed, pero puede haber penalizaci\u00f3n si ya hemos comenzado las gestiones ante Stellantis.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00bfQu\u00e9 pasa si gano el caso? \u2192 El bufete retiene el porcentaje pactado sobre la cantidad recuperada.<\/span><\/li>\n<\/ul>\n<h2><b>Paso 4: Fase de Negociaci\u00f3n Extrajudicial<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Antes de acudir a los tribunales, se intentar\u00e1 una <\/span><b>resoluci\u00f3n amistosa<\/b><span style=\"font-weight: 400;\"> con la parte demandada (Stellantis o sus marcas). Esta fase:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se basa en el env\u00edo de requerimientos legales y comunicaci\u00f3n formal y directa con Stellantos.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Permite acelerar el proceso y reducir costes judiciales.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Puede concluir en acuerdos econ\u00f3micos sin necesidad de juicio.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">En estos momentos la duraci\u00f3n media de esta fase puede oscilar entre 2 y 3 meses.<\/span><\/p>\n<h2><b>Paso 5: Proceso Judicial (si la negociaci\u00f3n falla)<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Si no se alcanza un acuerdo extrajudicial, se inicia el procedimiento judicial a trav\u00e9s de la <\/span><b>v\u00eda judical<\/b><span style=\"font-weight: 400;\">. En este punto, si dar\u00e1 comienzo al proceso mediante una <\/span><b>conciliaci\u00f3n judicial<\/b><span style=\"font-weight: 400;\">, donde:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nosotros proponemos un acuerdo formal a trav\u00e9s del juzgado.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Si Stellantis no acepta negociar o no alcanzamos un acuerdo, se contin\u00faa con la demanda judicial.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 1rem;\"><br><\/span><\/p><p><span style=\"font-size: 1rem;\">La conciliaci\u00f3n puede durar en torno a 6 meses.&nbsp;<\/span><span style=\"font-size: 1rem;\">El juicio puede tardar entre 12 y 24 meses dependiendo del juzgado asignado y de la cuant\u00eda a reclamar. Si se recurriese la sentencia este tiempo podr\u00eda incrementarse hasta los 5 a\u00f1os.<\/span><\/p>\n<h2><b>Costes del Proceso y Honorarios<\/b><\/h2>\n<h3><b>\u00bfCu\u00e1nto cuesta reclamar?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">En este proceso <\/span><b>no hay ning\u00fan coste inicial<\/b><span style=\"font-weight: 400;\"> para el afectado. PureTech Legal trabaja bajo un modelo de <\/span><b>\u00abpago por \u00e9xito\u00bb<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>\u00bfQu\u00e9 porcentaje se queda el bufete si se gana?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">El despacho retiene un <\/span><b>porcentaje del 30 %<\/b><span style=\"font-weight: 400;\"> de la cantidad recuperada. Este porcentaje se detalla en la hoja de encargo y cubre todos los gastos legales y gesti\u00f3n del caso.<\/span><\/p>\n<h2><b>Seguimiento del Caso y Estado de la Reclamaci\u00f3n<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Todos los participantes tienen acceso a un \u00e1rea privada y&nbsp; un bolet\u00edn semanal donde podr\u00e1n:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consultar el estado de su expediente.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Subir documentaci\u00f3n adicional.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Estar al d\u00eda de los avances del proceso.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Adem\u00e1s, se enviar\u00e1n <\/span><b>notificaciones por correo electr\u00f3nico<\/b><span style=\"font-weight: 400;\"> ante cualquier cambio relevante.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 pasa si quiero abandonar la reclamaci\u00f3n?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">El afectado puede <\/span><b>desistir del proceso<\/b><span style=\"font-weight: 400;\">, aunque se deben tener en cuenta las siguientes consideraciones:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Una vez recibida la documentaci\u00f3n y analizado su caso el afectado recibir\u00e1 un email con nuestra opini\u00f3n sobre su caso. Si es APTO tendr\u00e1 15 d\u00edas para decidir si desea continuar con el proceso, En caso de continuar deber\u00e1 abonar 50 \u20ac por el an\u00e1lisis realizado. En caso contrario podr\u00e1 desistir sin ning\u00fan tipo de coste. Si el caso no se considera apto tampoco se genera ning\u00fan tipo de coste.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Una se haya iniciado el proceso y en funci\u00f3n del avance de la reclamaci\u00f3n el afectado que quiera desistir deber\u00e1 asumir un coste de entre 200\u20ac y 400\u20ac<\/span><span style=\"font-weight: 400;\">.
